Lynas Corporation: Malaysian Court Update

Lynas-Corporation-LtdDecember 18, 2012 (Source: Lynas Corporation) — Lynas Corporation (ASX:LYC, OTC:LYSDY) understands that persons associated with the Save Malaysia Stop Lynas group (Applicants) have brought another application to the Kuantan High Court seeking to challenge the process involved in the issuance of Lynas’ Temporary Operating Licence (TOL).

In this case, the Applicants are seeking leave to apply for judicial review of the Atomic Energy Licensing Board’s decision to issue the TOL to Lynas. The Kuantan High Court has deferred the consideration of the Applicants’ right to apply for judicial review until 29 January 2013.

A similar application for leave for judicial review was dismissed by the Kuantan High Court in April 2012. An appeal of that decision was dismissed by the Malaysian Court of Appeal in September 2012.

There is no injunction or stay preventing Lynas from carrying out its operations at its Malaysian plant.
